President Tinubu’s unconstitutional move to suspend Rivers State’s elected Governor, Siminalayi Fubara, and appoint Vice Admiral Ibokette Ibas (rtd), an unelected individual, to lead the State is a blatant assault on our nation’s democracy, neglecting the votes and rights of the people of Rivers State to elect their leader under the Constitution.
The President’s actions appear to be an attempt at state capture, marking the peak of a deliberate strategy to forcibly take over Rivers State, which the All Progressives Congress (APC) has been intent on destabilizing to ensure democracy is ultimately thwarted in the State.

Nigerians should take note that the situation in Rivers State and the justifications presented by the President do not support the declaration of a state of emergency under the 1999 Constitution, making the declaration entirely invalid.
The statement continues to highlight
“The PDP warns that this unwarranted imposition of emergency rule in Rivers State is part of a broader malign strategy to instill a siege mindset across Nigeria, diminish opposition, establish an authoritarian one-Party State, and turn the nation into a dominion.
Furthermore, nothing in Section 305 of the 1999 Constitution, on which the President based his decision, gives him exclusive power to declare or enforce a state of emergency without the statutory approval of the National Assembly.
To clarify, Section 305 (2) specifies that ‘The President shall, immediately after publication, send copies of the Official Gazette of the Government of the Federation containing the proclamation, including details of the emergency, to the President of the Senate and the Speaker of the House of Representatives. Each shall convene or organize a meeting of their respective Houses to consider and decide whether to pass a resolution approving the proclamation.
Mr. President should acknowledge that instructing an unelected individual to assume control of Rivers State’s governance is illegal, posing a risk of crisis and threatening the peace and stability of not only Rivers State but the entire nation.
It is important to stress that Governor Fubara was elected through a democratic process for a four-year term, which cannot be curtailed unconstitutionally.
The PDP advises Vice Admiral Ibokette Ibas (rtd) to uphold the Constitution and refrain from actions that could disrupt the smooth democratic governance in Rivers State.
Nigeria is not subject to military rule, where State Governance is by appointment of a junta.”
